Some Good News - from last week

  • HB 1520which sought to invent a new concept of “New Hampshire citizenship” for voting and would have required voters born outside the state to swear an “oath of allegiance” to NH in order to vote—was unanimously recommended Inexpedient to Legislate (ITL) by the House Election Law Committee.

  • HB 1382, which would have required certain overseas voters to submit documentary proof of citizenship despite already being eligible under federal law, was also defeated after its sponsor acknowledged the bill conflicted with federal law, leading the committee to unanimously recommend ITL before the full House killed it.

  • Governor Ayotte vetoed SB 268, a bill that would permit discrimination against transgender people. Thanks to all who made phone calls, and thanks especially to 603 Equality for their leadership in defeating this dangerous bill.

  • Rockingham County commissioners voted to table – indefinitely – a proposal to use their county jail as an immigrant detention center. 

  • The House Criminal Justice and Public Safety Committee voted unanimously to recommend defeat for three death penalty bills and to amend a fourth bill removing the death penalty.  All four of these bills will go to the House floor in the coming weeks where we hope and expect that they will be fully defeated.

Libraries in NH Under Attack - Again - Still??

OPPOSE HB1214, relative to public libraries.

This bill is included in the Sign-ins below but I’m highlighting it here…

@ 2:10 PM on Tuesday, February 10th, the House Municipal and County Government Committee will hold a public hearing on HB1214 in a move to strip NH public libraries of their autonomy.

Talking Points:

  • HB1214 allows a municipality's governing body to assume governance of a public library. If a municipality's governing body assumes control of the public library, the library trustees shall serve in an advisory role to the governing body.  

  • The New Hampshire Library Association opposes this bill.

  • The bill strips authority from independent library trustees (elected by town residents) and allows town governing bodies to take direct control of public libraries. 

  • Public libraries depend on independence, stability, and public trust. Libraries are intentionally governed independently, so they can provide free and equal access to information without political interference.

  • Library trustees safeguard intellectual freedom, ensure responsible stewardship of public and donated funds, and provide stability beyond shifting political priorities. Weakening their authority risks politicizing library operations, collections, and services meant to serve the entire community—not those in power.

    If passed, this bill would take effect just 60 days after passage.

    SUPPORT 1716-FN, relative to the academic accountability of education freedom accounts.Rep. Peggy Balboni (D-Rye) for the Minority of Education Policy and Administration: This bill would add student academic accountability to the Education Freedom Account (EFA) program. Annual student assessment is a requirement of all NH public school students, and test scores are often used as a measure of a school’s success. The EFA program is funded with taxpayer dollars and is one of four education pathways for NH students. Currently, there is no comparable academic accountability required for students in the EFA Program. Per state law, students in the EFA program must provide an annual record of educational attainment by taking either a nationally standardized test or the NH statewide assessment; or submitting a statement of teacher evaluation of a student portfolio. This bill does not propose any new methods of evaluation, it merely clarifies the portfolio option and adds a reporting requirement to an already existing statute. The minority feels that all students in taxpayer-funded educational programs, including public schools, charter schools, and the EFA program, should be held to the same academic reporting standards to evaluate student growth and the success of the program. 
    OPPOSE HB1719, removing Hepatitis B from the list of diseases for which immunization is required under state law.
    Rep. William Palmer (D-Cornish) for the Minority of Health, Human Services and Elderly Affairs: This bill eliminates the Hepatitis B vaccine requirement and would make New Hampshire only the third state to do so. This is against the recommendation of the New Hampshire State Epidemiologist, the Infectious Disease Society of America, the American College of Physicians, the American Academy of Pediatrics, and the American Academy of Family Physicians. All the physicians who testified at the hearing were opposed to this bill, noting that the benefits far outweigh the risks of this vaccine. Since the universal birth vaccine dose became available in 1991 there has been a 95% drop in infant infections. Removal of the Hepatitis B vaccine requirement would further erode New Hampshire’s already declining vaccination rates, putting children, staff and community at increased risk for a disease that can cause cirrhosis, liver cancer and death. 
    OPPOSE HB1002repealing the solar energy systems tax exemption.
    Rep. Kat McGhee  (D-Hollis) for the Minority of Science, Technology and Energy: This bill repeals the solar energy systems tax exemption that allows towns to opt into solar energy tax exemptions if it fits their plans to lower local energy demand and costs. One hundred and fifty three cities and towns are using this exemption to support local sustainable energy adoption. The Hudson tax assessor was sent by his select board to ask us not to pass this bill. The tax impact was ‘in the noise’ and the town was committed to the exemption. Passing this bill upends traditional respect for local control. In every case of the towns who will be affected by this if it goes forward, voters spoke on what they thought was best. The minority believes passing this bill tells them they were wrong.

Social Media Storm: Stop the SAVE Act 2.0

As we mentioned last week, Republicans have renewed their efforts to advance the Safeguard American Voter Eligibility Act (SAVE Act). This time, with two new iterations of that legislation (the Make Elections Great Again Act (MEGA) and the Save America Act). While under new names, these new bills are part of the same effort by Republican members of Congress to disenfranchise millions of eligible voters from participating in upcoming elections.

How the SAVE Act (+ SAVE 2.0) will put up barriers 

  • The SAVE Act would require all eligible Americans to provide proof of citizenship by presenting a passport or birth certificate when registering to vote. This would be on top of voter ID laws that the majority of states already have in place. Why this is an issue:
